1. General Provisions
These Terms and Conditions define the rules of providing services via Pixeria available at https://pixeria.io, operated by Marcin Frątczak Framar with registered office in Katowice, Poland (VAT No.: PL6252163911). By registering or using the Service, you confirm acceptance of these Terms.
2. Definitions
Service - Pixeria platform for photographers at pixeria.io. User - any person or entity using the Service. Account - individual user profile protected by login and password. Subscription Plan - paid package of services (Free, Hobby, Pro). Gallery - collection of photos shared with clients.
3. Technical Requirements
To use the Service you need: a device with internet access, a modern web browser (Chrome, Firefox, Safari, Edge), an active email address, and a modern smartphone or tablet for full functionality.
4. Account Registration
Create account via email/password or Google/Apple login. Must be 18+ or have guardian consent. Provide accurate information and keep your password confidential. You are responsible for all account activity. One account per person unless otherwise agreed.
5. Service Features
Core features include: Photo Galleries (upload and organize), Gallery template selection, Proofing System (clients select and approve photos), Public and password/email protected galleries, Contact page, Photo ordering, Custom domain (Pro+), White label branding (Max), Stripe payments (Max), and Priority support (Max). Storage limits: Starter - 25 GB, 15 galleries (100 photos each); Pro - 100 GB, 100 galleries (500 photos each); Max - 250 GB, unlimited galleries (1000 photos each).
6. Subscription Plans and Payments
Starter Plan: $8.49/month or $6.99/month billed yearly. Pro Plan: $17.99/month or $14.99/month billed yearly. Max Plan: $47.99/month or $39.99/month billed yearly. Prices include VAT where applicable. Payments processed via Stripe. Subscriptions renew automatically. Cancel anytime from account settings. 14-day money-back guarantee for new customers. New users get a 14-day free trial - no credit card required.
7. Usage Rules
Use the Service for lawful photography business purposes only. Do not: upload illegal, offensive, or copyrighted content without permission; share account credentials; attempt to hack or disrupt the Service; use the Service for spam or fraudulent activities; exceed reasonable usage limits.
8. Intellectual Property
Pixeria platform, logo, and software are our property. You retain copyright to photos you upload. By uploading, you grant a license to display and store content as part of Service. Respect copyright laws when sharing photos.
9. Liability and Warranties
We strive for 99% uptime but cannot guarantee uninterrupted service. We are not liable for service interruptions beyond our control, data loss due to user actions, or third-party content or services. For business users, our liability is limited to fees paid in the last 12 months. Consumer rights are not affected by these Terms.
10. Data Protection
Your data is processed according to our Privacy Policy. Key points: EU servers, GDPR compliant, encrypted data transmission, you control your data, right to access, correct, and delete data.
11. Service Termination
You may delete your account anytime from settings. Active subscriptions continue until the period end. No refunds for partial months (except money-back guarantee). We may terminate accounts that violate these Terms, engage in fraudulent activity, fail to pay subscription fees, or pose security risks.
12. Changes to Terms
We may update these Terms with 14 days notice. Continued use means acceptance.
13. Dispute Resolution
Governing Law: Polish law. All consumer protection rights are retained. Disputes are resolved amicably or through competent courts.
